SHAKOPE E TO: Mayor and City Council Mark McNeill, City Administrator FROM: Samantha DiMaggio, Economic Development Coordinator DATE: 05/21/2013 SUBJECT: Approval of Applications to the Minnesota Department of Employment and Economic Development's (DEED) Business Development Public Infrastructure Grant Program - Res. No. 7302 and No. 7303 (D) Action Sought Approve a motion to allow staff to apply to DEED's Business Development Public Infrastructure Grant Program. Upon approval of the applications by the state, the City of Shakopee will enter into an agreement with the State of Minnesota. Background The Innovative Business Development Public Infrastructure (BDPI) program focuses on job creation and retention through the growth of new innovative businesses and organizations. The program provides grants to local governmental units on a competitive basis statewide for up to 50 percent of the capital cost of the public infrastructure necessary to expand or retain jobs. Local governmental units, such as cities and counties, are eligible to apply for these grants. Cities must provide a 50% match of the project capital costs. In these cases, the local match will be provided through either assessments against the benefitted properties, or otherwise provided by the benefitting company. The projects must be for publicly -owned infrastructure related to a development project, including projects that target manufacturing, technology, warehousing and distribution; research and development; innovative business incubator; agricultural processing; or industrial, office, or research park development that would be used by an innovative business. Funds from this program can also be used for land acquisition and preparation, telecommunications, bridges, parking ramps, demolition, hazard remediation, pre- design, construction, equipment and furnishings. The two Shakopee projects contemplated for these grants are Rosemount, Inc., and Compass Datacenters. Recommendation Staff recommends approving the submittal of applications for the Business Development Public Infrastructure Grant Program, in the amount of $1,200,000 for Rosemount Inc. and $250,000 for Compass Datacenters, LLC. Budget Impact The local matches would be provided via assessments against the benefiting properties. Relationship to Vision This supports Goal D, "Maintain, improve, or create strong partnerships with other public or private sector entities." Requested Action If the Council concurs, it should, by motion, approve the following Resolutions: Resolution No. 7302, A Resolution Authorizing Application for a Business Development Public Infrastructure Program Grant Through the Department of Employment and Economic Development for Compass Datacenter, LLC. Resolution No. 7303, A Resolution Authorizing Application for a Business Development Public Infrastructure Program Grant Through the Department of Employment and Economic Development for Rosemount Inc. CITY OF SHAKOPEE, MINNESOTA RESOLUTION NO. 7302 RESOLUTION AUTHORIZING SUBMISSION OF BDPI GRANT APPLICATION BE IT RESOLVED that the City of Shakopee act as the legal sponsor for project(s) contained in the Business Development Infrastructure Application to be submitted on May 22, 2013 and that the Mayor and the City Clerk are hereby authorized to apply to the Department of Employment and Economic Development for funding of this project on behalf of Compass Datacenters, LLC. BE IT FURTHER RESOLVED that the City of Shakopee has the legal authority to apply for financial assistance, and the institutional, managerial, and financial capability to ensure matching funds, adequate construction, operation, maintenance and replacement of the proposed project for its design life. BE IT FURTHER RESOLVED that the City of Shakopee has not violated any Federal, State, or local laws pertaining to fraud, bribery, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice. BE IT FURTHER RESOLVED that upon approval of its application by the state, the City of Shakopee may enter into an agreement with the State of Minnesota for the above - referenced project, and that it will comply with all applicable laws and regulations as stated in all contract agreements. BE IT FURTHER RESOLVED that upon approval of its application by the state, the City of Shakopee, will commit $250,000 towards the local match requirement. BE IT FURTHER RESOLVED that the City of Shakopee will the repay the grant if milestones are not realized by the completion date identified in the Application. The City of Shakopee certifies that it will comply with all applicable laws, regulations, and rules of the Business Development Infrastructure Application. NOW, THEREFORE BE IT RESOLVED that the Mayor and the City Clerk or their successors in office, are hereby authorized to execute such agreements, and amendments thereto, as are necessary to implement the project(s) on behalf of the applicant.
