Action Sought
The City Council is asked to adopt Ordinance No. 869 adding the Woodland Alteration Permit Fee to the City's fee
schedule.
Background
On April 16, 2013 the City Council adopted Ordinance No. 866 approving the text amendments to the City Code
Chapter 11.60 Subd. 9, Tree Management Regulations. The EAC and Planning Commission reviewed and
recommended the approved text amendments to the City Council prior to April 16th. The text amendments include
the development of a Woodland Alteration Permit.
Discussion
A Woodland Alteration Permit will be required for any private or public infrastructure and utility installation,
building construction, excavation, grading, clearing, filling or other earth change on any parcel of land, or adjacent
parcels of land in common ownership greater than two and one half (2.5) acres in size where any cutting, removal
or killing of more than 10% of the significant trees on any such parcel of land will occur. Properties under 2.5
acres do not need a Woodland Alteration Permit and therefore do not pay a fee. The City does not currently have a
Woodland Alteration Permit.
The City currently has a tree planting permit that is free to any applicant that wishes to plant a tree in the
right -of -way, conservation easement, park and open space or drainage and utility easement. Staff is recommending
keeping the tree planting permit separate from the Woodland Alteration Permit based on staffing requirements to
manage each permit. Staff is recommending a fee requirement for the Woodland Alteration Permit based on the
size of the project property. The fee recommended has been developed to cover the staff time required to review the
tree inventory and tree removal/preservation plan. Larger properties require additional staff time. The EAC
discussed the recommended permit fee at their March 8, 2013 meeting and recommend to the City Council the
inclusion of the new fee into the City's Annual Fee Schedule. The fees recommended are $250 for properties 2.5 to
4 acres and $500 for properties greater than 4 acres.

Requested Action
The City Council should, if concurs, offer Ordinance No. 869, An Ordinance of the City of Shakopee, Minnesota,
Amending the City's Adopted 2013 Fee Schedule to Add the Woodland Alteration Permit Fees, and move its
adoption.

THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS:
WHEREAS, the City Council adopted Ordinance Number 866, approving text
amendments to the City Code Chapter 11.60 Subd. 9, Tree Management Regulations; and
WHEREAS, a Woodland Alteration Permit is required for any private or public
infrastructure and utility installation, building construction, excavation, grading, clearing, filling
or other earth change on any parcel of land, or adjacent parcels of land in common ownership
greater than two and one half acres in size where any cutting, removal or killing of more than
10% of the significant trees on any such parcel of land will occur; and
WHEREAS, the City Council has determined that it is desirable to modify the 2013 Fee
Schedule in order to add the amounts of permit fees to be charged for Woodland Alteration
Permits.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Shakopee
that the Adopted 2013 City Fee Schedule is amended as follows:
Woodland Alteration Permit
Properties 2.5 to 4 acres $250.00
Properties greater than 4 acres $500.00
Adopted in adj. regular session of the City Council of the City of Shakopee, Minnesota,
held this 21 day of May, 2013.
