Action Sought
Offer a motion to approve Resolution No. 7309, A Resolution Approving the Final Plat of Dean Lakes Ninth
Addition and move its approval. This action has no immediate budget impact.
DISCUSSION
Ryan Companies and Compass Datacenters have filed an application for Final Plat approval of Dean Lakes Ninth
Addition, Caselog No. 13 -016. This application has a review period deadline of July 26, 2013. The proposed plat
is on property located south of Dean Lakes Blvd, east of Dean Lakes Trail and north of Coneflower Lane. A
location map depicting the subject site is attached for the Council's reference. The subject site is approximately 22
acres in size and proposes the creation of 2 lots. The eastern most lot is anticipated to be developed by Compass
Datacenters. The remaining lot would remain available for development.
Other departments and agencies have reviewed the application and have provided comments. All applicable
comments have been incorporated into the draft resolution of approval and copies of comments received have been
attached for Council's reference.

ALTERNATIVES
1. Approve the Final Plat of Dean Lakes Ninth Addition, subject to the conditions presented.

3. Deny the Final plat of Dean Lakes Ninth Addition.
4. Table a decision and request additional information from staff and/or the applicant.
STAFF RECOMMENDATION
Staff recommends the approval of the Final Plat of Dean Lakes Ninth Addition, subject to the conditions proposed
in Resolution No. 7309 (Alternative No. 1).

Based on a review of the application materials provided to staff, staff has the following
conditions of approval:
1. The applicant proposes in the landscaping plan to plant 17 Colorado Spruce.
The Colorado Spruce is not an acceptable tree to plant. The applicant must
submit an updated landscaping plan proposing a species other than the Colorado
Spruce. All other species of trees are acceptable.

The application indicates a request for a Final Plat and Conditional Use Permit (CUP) review of a
Business Park (BP) zoned subdivision located in the Dean Lakes 5th Addition. The properties are
east of Dean Lakes Trail and south of Dean Lakes Boulevard.
This review is preliminary, as more comments will follow with additional submittals. However,
the engineering department offers the following comments at this time for the applicant and
for the planning department:
General Conditions
The following items need to be addressed /completed prior to release of the Final Plat for
recording:
1. Execution of a Developer's Agreement, which needs to include provisions for security
for public improvements within the Final Plat and the engineering review fees.
2. Payments of Trunk Storm Water Charges need to be made, as required by the most
current City of Shakopee Fee Schedule.
3. Provide electronic files (AutoCAD and Adobe Acrobat formats) of the Final Plat to be
recorded with datum on the Scott County coordinate system.
The following items need to be addressed /completed prior to approval of a grading permit
and /or a street and utility plan:

1. The applicant needs to obtain a NPDES permit prior to any land disturbing activity. A
copy of this permit will be provided to the City.
2. The applicant will grade the site, as proposed on the approved plans, in one phase
within one year from the date of approval of the grading permit application. Grading is
defined as bringing the site to the proposed finished grade with materials deemed
acceptable by the City of Shakopee engineering department, providing topsoil per City
requirements and applying seed, mulch and /or sod per City requirements and providing
an as -built record grading plan per Section 2.5 of the City of Shakopee Design Criteria.
3. The applicant will remove the proposed berm from the drainage and utility easement
adjacent to Coneflower Lane.
4. The applicant will provide a detailed signing and striping plan for the interior street
system.
5. The removal of the curb cut at Coneflower Lane and Woodland Avenue will require a
right -of -way permit. Please contact Jim Henderson at (952) 233 -9368 for details.
6. The applicant will work with Shakopee Public Utilities (SPU) staff to eliminate the
watermain connection at Coneflower Lane and Woodland Avenue.
7. The applicant will extend FES #1 to the normal water elevation.
8. Class IV fieldstone riprap needs to be placed at each flared end section outletting to the
storm water basins. The riprap will be placed to the bottom of the storm water basins.
9. As multiple buildings are being served by the sanitary sewer and there is potential for
subdividing these into separate Tots in the future, the mainline sanitary sewer and any
extensions to the west will be public.
10. The applicant needs to work with the City of Shakopee engineering staff to provide
trunk sanitary sewer extensions to serve properties to the west. The extensions to
investigate are at the northern and southern portions of Lot 2, Block 1.
11. In order to reduce maintenance responsibilities, the applicant will work with the City of
Shakopee engineering staff to eliminate the proposed manhole at the connection to
existing sanitary sewer near Dean Lakes Boulevard.
12. The applicant will work with the City of Shakopee engineering staff to move MH — (111)
further south to provide a sanitary sewer extension to the west.

13. The applicant will work with the City of Shakopee engineering staff to provide separate
private sanitary sewer services to each building.
14. The applicant needs to revise the proposed landscaping plan to be in compliance with
the most recent version of the City of Shakopee's Easement Fencing and Landscaping
Policy.
15. No landscaping will be allowed in front yard drainage and utility easements, unless a
detailed plan is submitted clearly showing how all lots will be served by private utilities.
Prior to submittal, all applicable private utility companies will need to review and
approve this plan.
The following items need to be addressed /completed prior to issuance of a building permit:
1. Record plans need to be provided per the City of Shakopee Design Criteria, Section 2.5
and Section 11.2 (A -L). The record plans need to be submitted to the engineering
department.
2. The applicant will provide a detailed lot area drawing. At a minimum, this drawing will
show the total lot area, the total pervious area and the total impervious area.
Final Plat Conditions
The following items need to be addressed /completed prior to release of the Final Plat for
recording:
1. Right -of -way, in the form of sight triangles fifteen (15) feet in dimension, will be
provided at the southernmost entrance to the property.
2. Easements need to be shown on the Final Plat as approved by the City Engineer. They
will include, but are not be limited to, the following:
• Minimum drainage and utility easements for public sanitary sewer will be dedicated
per the City of Shakopee Design Criteria, Section 10.1 (A -D). The easements need to
be centered along the public utility alignments.
• Provide adequate drainage and utility easement centered on the public sanitary
sewer.
• The City of Shakopee will retain all existing easements.
Recommendation
Engineering staff recommends approval of the Final Plat and CUP application subject to the
conditions referenced above being addressed /completed by the applicant.

Project Comments
1. Proposed use is a Group B (Business) Occupancy. (MSFC Chapter 2) Depending on
design there may be battery storage areas meeting a Group H (High- Hazard)
Occupancy.
2. The plan submitted for review as part of the Final Plat and CUP contains several
issues that will need to be addressed as the project moves forward. These include:
a. areas where the proposed fence crosses roads with no gates indicated
b. there are multiple water connection locations for each building
c. watermain and hydrant locations do not meet SPUC requirements
d. site layout maybe changing
3. Subject property is within Insurance Service Office (ISO) requirements for fire
department engine company coverage based on current fire station placement.
Requirements for ISO are an engine company within 1.5 miles. This facility is
currently 1.3 miles from a fire station.
4. Subject property is not within Insurance Service Office (ISO) requirements for fire
department ladder company coverage based on current fire station placement.
Requirements for ISO are a ladder company within 2.5 miles. This facility is currently
1.3 miles from a fire station.

include, but are not limited to: installing a lateral water main distribution system in
accordance with utility policy, paying the associated inspections costs, granting any

Underground electric service is available subject to our standard terms and conditions.
These include, but are not limited to: entering into an Underground Distribution

RESOLUTION NO. 7309
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING
THE FINAL PLAT OF DEAN LAKES NINTH ADDITION
WHEREAS, Compass Datacenters, applicant and Ryan Companies, property
owner, have made application for final plat approval of Dean Lakes Ninth Addition; and
WHEREAS, the subject property is legally described as:
Lots 1- 5, Block 1, Dean Lakes 5 Addition, Scott County, Minnesota; and
WHEREAS, the City Council reviewed the final plat on May 21, 2013.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Shakopee, Minnesota that the final plat of Dean Lakes Ninth Addition is hereby approved
subject to the following conditions:
1) The following procedural actions must be completed prior to the recording of
the Final Plat:
a) Approval of title by the City Attorney.
b) Right -of -way, in the form of sight triangles fifteen (15) feet in dimension, will be
provided at the southernmost entrance to the property.
c) Easements need to be shown on the Final Plat as approved by the City Engineer.

13. The applicant will work with the City of Shakopee engineering staff to provide
separate private sanitary sewer services to each building.
14. The applicant needs to revise the proposed landscaping plan to be in compliance
with the most recent version of the City of Shakopee's Easement Fencing and
Landscaping Policy.
15. No landscaping will be allowed in front yard drainage and utility easements,
unless a detailed plan is submitted clearly showing how all lots will be served by
private utilities. Prior to submittal, all applicable private utility companies will
need to review and approve this plan.
3) The following procedural actions must be completed prior to the issuance of a
building permit:
a) Record plans need to be provided per the City of Shakopee Design Criteria,
Section 2.5 and Section 11.2 (A -L). The record plans need to be submitted to the
engineering department.
b) The applicant will provide a detailed lot area drawing. At a minimum, this
drawing will show the total lot area, the total pervious area and the total
impervious area.
4) Following approval and recording of the final plat, the following conditions
shall apply:
a) All conditions from Resolution No. 5986 (Dean Lakes PUD) shall be complied
with.
b) The applicant shall provide six inches of topsoil for the establishment of turf and
plantings. The soil composition should be similar to the MnDOT topsoil borrow
requirements.
c) Irrigation systems require rain sensors.
