DISCUSSION
City Engineering has reviewed the conditions noted in the draft resolution, and after discussing
further several elements of this project, have recommended changes which have been ~.
incorporated in a revised resolution (attached). Specifically, Condition No. I B 1 was
eliminated, and new Conditions No. I B 6 and I B 7 have been revised. When reviewing and
considering approval of this project, please reference this revised resolution.

A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE
FINAL PLAT OF RIVER V ALLEY ESTATES 2ND ADDITION
WHEREAS, Pulte Homes of Minnesota Corporation, applicant and property owner, has
made application for final plat approval of RIVER V ALLEY ESTATES 2ND ADDITION; and
WHEREAS, the subject properties are legally described as:
Outlot A, RIVER V ALLEY ESTATES 1 ST ADDITION; and
WHEREAS, the Shakopee Planning Commission conducted a public hearing on the
preliminary plat on January 6 and February 3,2005; and
WHEREAS, all required public notices regarding the public hearing were posted and sent;
and
WHEREAS, the Shakopee Planning Commission has recommend approval of the
preliminary plat; and
WHEREAS, the City Council reviewed and approved the preliminary plat request at its
meeting of February 15, 2005,
WHEREAS, the City Council reviewed the RIVER V ALLEY ESTATES 2ND
ADDITION final plat request at its meeting of January 17, 2006.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA, as follows:
I. The following procedural actions must be completed prior to the recording of
the Final Plat:
A. Approval oftitle by the City Attorney.
B. Execution of a Developers Agreement, which shall include provisions for
security for public improvements within the Final Plat, and any engineering
review fees as required by the City's adopted fee schedule.
1. Street lighting to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
2. Electrical system to be installed in accordance with the requirements
of the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
4. The developer shall be responsible for payment of Trunk Storm
Water Charges, Trunk Storm Water Storage and Treatment Charges,
and Trunk Sanitary Sewer Charges, as required by the most current
City of Shakopee Fee Schedule.
5. No public improvements shall be constructed until the City Engineer
and the Shakopee Public Utility Commission approve the Final
Construction Plans and Specifications.
6. The applicant agreed to contribute a total of$150,000 towards the
extension of a trunk sanitary sewer to serve the site. The remaining
balance of $90,000 shall be paid to the City of Shakopee.
7. The applicant agreed to contribute the cost of the proposed temporary
lift station and associated appurtenances towards the extension of a
trunk sanitary sewer to serve the site, should it be available for
connection. If the trunk sanitary sewer is available for connection,
the need for a temporary lift station is eliminated and the agreed upon
cost shall be paid to the City of Shakopee.
8. Should a temporary lift station be necessary, the applicant shall pay
all costs associated with the removal of the temporary lift station and
its associated appurtenances as well as pay all costs associated with
the connection to the permanent facilities when available. A security
amount, approved by the City of Shakopee, shall be provided for this
work.
9. Should a temporary lift station be necessary, the applicant shall
connect to the permanent trunk sanitary sewer at the time it is made
available.
10. All proposed tempot:ary lift station and associated appurtenances
shall be new and not previously used.
11. The applicant shall be responsible for the installation of trunk
sanitary sewer through their site.
12. The applicant shall obtain the necessary permits, approvals, right-of-
way and/or easements to perform any proposed work offsite.
13. The applicant shall obtain the necessary Scott County
permits/approvals (right-of-way, drainage; etc.).
14. Sidewalks and trails shall be provided throughout the site as
proposed.
15. The applicant shall meet the park dedication requirement by
providing cash in lieu of land dedication. Park dedication fees in the
amount required by the City Code and adopted City fee schedule
($267,000, based on $5,340 X 50 lots) shall be paid prior to the
recording of the final plat.
C. Temporary street signs shall be in place prior to field inspections.
D. Permitted lots shall be accessible, consistent with the Building Official's
requirements.
E. Provide electronic (Auto CAD) files ofthe Final Plat to the City Engineering
Department.
F. Easements shall be shown on the Final Plat as approved by the City
Engineer. They shall include, but not be limited to, the following:
1. Minimum drainage and utility easements for sanitary sewer and
storm sewer in non-paved areas shall be provided at a one to one
ratio, depth versus width, plus four (4) feet. The easements shall be
centered along the utility alignment.
2. Provide additional drainage and utility easement in the rear of Lots
12, 13 and 14 of Block 2 to adequately encompass the emergency
overflow route.
3. Provide a total of twenty-five (25) feet of drainage and utility
easement centered on the lot line between Lots 18 and 19 of Block 3.
4. Provide a total of thirty-six (36) feet of drainage and utility easement
centered on the lot line between Lots 19 and 20 of Block 3.
G. Simultaneous to the recording ofthe Final Plat, a deed restriction shall be
recorded on drainage and utility easements adjacent to all property lines as
designated by the City Engineer.
The Deed Restriction shall appear as the following:
This conveyance is made conditioned upon and subject to the following
restriction. The Grantee, heirs, successors and assigns, are restricted from
erecting any fence or other structure within the utility and drainage easements
dedicated by plat over the above-described property, except with the prior
written consent of the City of Shako pee. This restriction shall run in favor of
and be enforceable by the City of Shako pee.
II. Following approval and recording of the final plat, the following conditions
shall apply;
A. Building construction, sewer, water service, fire protection and access will
be reviewed for code compliance at the time of building permit
application(s).
B. Noise issues along the County roadways may arise as traffic levels increase
in the area. The developer and/or their assigns shall be responsible for any
required or desired noise mitigation measures.
C. The developer and/or their assigns shall be responsible for the maintenance
of all areas held in common ownership.
D. The developer should implement the use of Best Management Practices for
erosion control and stormwater management during construction.
E. Provide placement of at least one overstory/shade deciduous tree inthe front
yard.
F. Provide sod placement in front yard and seed or sod placed in side and rear
yards.
G. Provide placement of 6" of topsoil. The. soil composition should be similar
to the MnDOT topsoil borrow requirements.
H. Provide rain sensors for any irrigation system.
1. Replace all proposed (23) Northern Pin Oak with Hackberry and/or a
suitable replacement approved by the City.
J. The existing field access to this property off CSAH 83 shall be completely
removed from the County right-of-way and graded to match the existing
ditch.
K. No landscaping, ponding, berming, or signage shall be permitted within the
County right-of-way.
L. Any change in drainage entering the County right-of-way requires detailed
stormwater calculations to be submitted to the County Engineer for review
and approval.
M. Any work within the County right-of-way shall require a permit.

REVIEW PERIOD: December 8, 2005 - April 7, 2006
DISCUSSION
Pulte Homes has made application for Final Plat approval of RIVER V ALLEY ESTATES 2ND
ADDITION. The property is located north of Valley View Road and west ofCSAH 83
(Exhibit A). The preliminary plat was approved on February 15,2005, with the 1st Addition
Final Plat approved July 5, 2005. The property located in the 2nd Addition is approximately 24
acres in size, with 3.437 acres being dedicated for right-of-way. The plat proposes the creation
of 50 single family residential lots in this addition (Exhibit B). The developer proposes to save
a number of existing trees along the north property line, and intends to plant 256 new trees,
which would exceed the minimum requirements of the Woodland ordinance. The majority of
the proposed trees (80 of which are 8 foot to 12 foot tall pines) will be planted along CSAH 83
and Valley View Road, which will help minimize the noise impacts on this development from
these roads.
Joe Swentek, Project Engineer, has provided a memorandum noting City Engineering's
recommendations (Exhibit C), which has been attached for Council's review and incorporated
into the draft resolution.
Jim Grampre, Building Official, commented that if approved, temporary street signs shall be in
place prior to field inspections, and the permitted lots shall be accessible.
Judy Cox, City Clerk, recommended approval, provided the conditions outlined in the approved
preliminary plat resolution are met. Staff has determined that the final plat application for the 2nd
Addition is consistent with the approved preliminary plat.
Shakopee Public Utilities Commission provided a memorandum, noting conditions that should be
incorporated into the resolution, provided the request is approved. Those conditions are included
in the draft resolution attached to this report.
ALTERNATIVES
1. Approve Resolution No. 6356, a resolution approving the final plat of RIVER VALLEY
ESTATES 2ND ADDITION, as presented.

I. The following procedural actions must be completed prior to the recording of
the Final Plat:
A. Approval of title by the City Attorney.
B. Execution of a Developers Agreement, which shall include provisions for
security for public improvements within the Final Plat, and any engineering
review fees as required by the City's adopted fee schedule.
1. Provided the City extends the trunk sanitary sewer facilities along
CSAH 83 to this property, the developer shall contribute cash for that
project in lieu of providing a sanitary lift station and force main for
the future phase(s) of River Valley Estates.
2. Street lighting to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
3. Electrical system to be installed in. accordance with the requirements
of the Shakopee Public Utilities Commission.
4. Water system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
5. The developer shall be responsible for payment of Trunk Storm
Water Charges, Trunk Storm Water Storage and Treatment Charges,
and Trunk Sanitary Sewer Charges, as required by the most current
City of Shakopee Fee Schedule.

The application indicates a Final Plat request for a single-family residential development to be located

After reviewing the above referenced application, we have the following comments for the applicant
and the planning department:
General

Underground electric service is available subject to our standard terms and conditions.
These include, but are not limited to: entering into an Underground Distribution
Agreement, granting any necessary easements, and paying the associated fees.
