SUBJECT: Waiver of Subdivision Criteria: 916 3rd Avenue East
MEETING DATE: January 3,2006
INTRODUCTION:
Jim and Bonnie Wakely have submitted a request Jor approval of a waiver of subdivision
criteria for 916 3rd Avenue East. The parcel is zoned Old Shakopee Residential (R-1C). The
applicant wishes to construct a twin home on the subject property and then request a minor
subdivision to create individual parcels for each dwelling unit. The applicant is requesting
that the side yard setback be waived in order to allow a zero side yard setback for the lot line
along the common boundary of the twin home unit.
The applicant states that the new structure would replace an existing abandoned structure and
provide more than double the minimum side yard setbacks on both the east and west side
yards.
ALTERNATIVES:
1) Approve the requested waiver of subdivision criteria for sideyard setback in the R-l C
Zone to allow a zero side lot line for the parcel at 916 3rd Avenue East.
2) Do not approve the waiver of subdivision criteria.
3) Table the matter for additional information.
ACTION REQUESTED:
Offer and pass a motion consistent with the Council's determination.

Shakopee City Council Members:
We are requesting that you grant us a waiver regarding the current minimum side-yard set
back to allow for a zero lot line twin home to be built at the above named property. This
twin home will replace a 95 year old home that has been abandoned for a number of
years. This new structure, as designed, will have more than double the minimum side
yard set backs on both the East and West sides.
