SUBJECT: Petition of Tollefson Development for the Annexation of Land located in
Jackson Township
MEETING DATE: January 3,2006
INTRODUCTION:
The City received a petition from Tollefson Development for the annexation of approximately 45
acres ofland from Jackson Township into the City of Shakopee. The subject property is located south
of, and adjacent to, the plat of Countryside, and east of Marystown Road/CSAH 15. The public
hearing was opened on September 6,2005, and continued to December 6, 2005. At the December 6th
meeting, the Council directed staff to draft a resolution of denial for action on December 20th. A draft
resolution is attached for the Council's consideration. On December 20,2005, this item was deferred
by the Council upon the request of the petititioner.
ALTERNATIVES:
1. Approve Resolution No. 6346, a resolution of the City of Shakopee denying the requested
petition for annexation.
2. Direct staffto prepare a resolution of approval ofthe proposed annexation for action at the
Council's January 3, 2006 meeting
3. Table the item for additional information.
ACTION REQUESTED:
Offer a motion and pass a motion approving Resolution No. 6346, a resolution of the City of

RESOLUTION NO. 6346
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA DENYING A PETITION
FOR ANNEXATION OF ABOUT FORTY-FIVE (45) ACRES LOCATED ON THE EAST
SIDE OF MARYS TOWN ROAD/CR 15 AND SOUTH OF TH 169
WHEREAS, Tollefson Development Inc. submitted a petition for the annexation of certain
properties in Jackson Township totaling about 45 acres (Case File No. 05092); and
WHEREAS, the properties that are the subject of the petition are owned by Roger W. and
Susan M. Sames, Stuart A. Jacobson, Michael W. and Gail R. Kelso, and Garth and Catherine
Kangas; and
WHEREAS, the petition for annexation was reviewed by the Shakopee Planning
Commission, which recommended to the City Council that the annexation not proceed at this time;
and
WHEREAS, the Shakopee City Council held a continued public hearing on the subject
petition on September 6 and December 6, 2005.
NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of Shakopee
that it hereby adopts the following findings of fact;
1. That the subject property is not now urbanizing, and that urbanization ofthe subject
property is not imminent.
2. That the City of Shakopee has sufficient land available for development needs in the
immediate future without the proposed annexation.
3. That in 2005, the City allocated Metropolitan Urban Service Area (MUSA) to
nearly 400 acres of land from its pool of floating MUSA.
4. That the land to which MUSA is allocated is sufficient to meet the City's
development needs for the next couple of years.
5. That the City has designated phasing areas for the extension of MUSA, and that the
subject properties are in a later (Phase II) phasing area for MUSA
BE IT FURTHER RESOLVED, that the petition for annexation is hereby denied.
