First Ave. Shakopee, Minn. 55379 Dear Mr. Reeder: Thank you for submitting comments on the draft 208 Areawide Plan/ Development Guide for Water Quality Management. Our staff is currently summarizing and evaluating your comments and the Council ' s Physical Development Committee will be discussing and taking action on the comments made during the next several weeks . As a result of the substantial number of issues raised concerning the proposed plan and the extensive constructive comments received during the public comment period, the Metropolitan Council has decided that the draft plan will require a revision before a proposed final plan can be prepared for public hearing purposes. Therefore, the scheduled public hearing will be moved back several weeks until January 25 , 1979 . The public hearing draft plan will be mailed out in late December. This will assure a 30 day review period of the plan. When a report is completed on a summary of comments received on the public meeting draft we will send you a copy for your information. Again, thank you for your participation and comments on our public meeting draft of our 208 plan. Public comments are the key to success in the development of a workable plan. November 8, 1978 Walter Harbeck, Mayor City Hall City of Shakopee Shakopee, Minnesota 55379 Dear Walt: I own approximately 6z acres to the South of Shakopee Valley Publishing Company and abutting County Road #17. When I purchased this property I requested Commercial Zoning and it was so granted. With the City's present Moratorium on Platting and the indecision as to what the best use for this property is it is virtually impossible to sell as it has been put in a state of limbo. I want the present Zoning of Commercial to remain as is. I don' t think that Zoning it residential is a wise move or fair to me. I also don't think it is fair to me that I cannot sell this property as in the past four months I have had two buyers that were willing to purchase the property but could not get any cooperation from City Hall as to building permits. Also as you are aware there is a drainage problem caused by the in- crease of Platting and improvements on the property to the West. This also makes it detrimental to sales and will eventually cause erosion. I would expect the City to correct this problem. The City has also recently granted a building permit to add onto The Shakopee Valley Publishing building. If this area is presently being considered to be re-zoned residential or agricultural then I don't think it is right to approve the expansion of a commercial operation. I would appreciate being put on notice of any changes anticipated by the City in regard to the aforementioned property. Respectfully, J. If 44O ' EE a` 129 East First Avenue, Shakopee, Minnesota 55379 MEMO TO: Mayor and City Council FROM: Nancy Engman SUBJECT: Resolution No . 1325, "A Resolution Supporting a Public Priority DATE: November 7 , 1978 Project for the City of Shakopee" The City received notice on October 30, 1978, that the final application for Community Development Block Grant Funds was approved in the amount of $638,000. This provides funding to complete the Seventh and Minnesota Street Project, except it does not include mortgage financing for the twelve new homes to be built on the site . A set aside for these funds must be sought through applications for Federal 235 Funds and MHFA Affordable Home Funds . The Resolution offered at the November 8th City Council meeting provides for the City to request a reservation of MHFA mortgage money for use in the Seventh Street Project through September of 1979 . This opportunity is being offered through a pilot program at the State entitled 10Public Priority Projects" . It provides us with the mechanism of reserving the needed morpgage money solely for the Minnesota Street Project . Normally, the Affordable Home money would be available at the bank but could not be reserved for use in a particular area . I believe the reservation of mortgage money at this time is important to the program. Resolution No . 1325 must be part of the application submitted to the State for the set aside . Reeder, City Administrator SUBJECT:Valuatioa of Real Estate Property For Taxes Payable in 1980 DATE: November 3 , 1978 I am requesting that this City Council discuss with City Staff the general policies which will be followed for assessing property in the City of Shakopee . I have attached two computer print outs which show how Shakopee relates to other Scott County communities in the valuation of property. Because of current state laws , you should be aware of both of these comparisons . The estimated market value comparison shows how we compare with other communities on the value we place on the property . The limited value comparison shows how we compare on the value which is actually used to determine the taxes on a property. There are some substantial differences in these comparisons caused by the workings of the state law. These tables compare the cities for 1975 , 1976 and 1977 estimated values . In 1978 the City of Shakopee used a new rate sheet which was higher than the one we previously used and which is being used by Scott County for 1979 values (taxes payable in 1980) . The rate sheet which Shakopee used in 1978 (payable 1979) is much higher than the old rate sheet still used by Scott County. Because of this it is our feeling that when the ratio comparisons are available for 1978 (payable 1979) , Shakopee will be pretty high relative to other Scott County communities . For 1979 (payable 1980) the County plans to continue to use the old rate sheet , but plans on raising the value in the area of 10%. For 1980 (payable 1981) they plan to institute a new rate sheet which will raise the value about 20% over what Shakopee now uses . This will then mean that the County in 1980. (payable 1981 ) will have a very large increase in assessed valuation because they will be going from a rate sheet prepared in 1976 to a new one which is probably current for 1979 . For Shakopee the choice is very clear . If we do the job t he correct way we would raise our values again this year 1979 (payable 1980) and again in 1980 (payable 1981) and the increases then would be spread across two years and would appear smaller . The alternative for Shakopee is to not change our rate sheet from the one used in 1978 (payable 1979) and then use a new sheet in 1980 (payable 1981) which is similar to the one used by Scott County in that year . This would mean no increase in assessed valuation for 1979 (payable 1980) but a quite large increase for 1980 (payable 1981 . ) Our increase at that time would still be less than Scott County' s since we are now somewhat ahead . Recommendation It is recommended that the City Assessor be directed to not change the rate sheet for the 1979 (payable 1980) valuation. This is recommended for the following reasons : 1 . This will keep the Shakopee values in line with other Scott County communities and therefore not cause Shakopee taxpayers to pay an unfair share of County and School District taxes . 2 . The penalty which has been imposed by state law for not reaching an acceptable level of assessment has a maximum fine for Shakopee of $50,000. In addition, there appears to be some feeling of the State legislature that this law would cause all cities to pay some fine and therefore it may be changed . Reeder, City Administrator RE: City Assessor vs County Assessor DATE: November 3, 1978 Scott County has offered to take over the assessing functions for the City of Shakopee . They have suggested a price of $15 ,000 for doing this work. This price is very reasonable and cheaper than we can do it for. The 1979 budget for the Assessing Department is $35 ,00 0. Despite the cost savings we could enjoy, it is my recommendation that we thank the County for their offer, but continue to operate our own assessing department . The advantages of our operation are the following: 1 . Our personnel are more qualified than those employed by the County 2 . Local residents have much better access to and will enjoy better service from a local assessor 3. The local elected officials have more policy making power over a local assessor 4. The goal of having county wide equalization by having the County do all the assessing is not obtained now for the jurisdictions being assessed by the county and there is no reason to believe that this would change 5 . The assessing staff is a big help to the functioning of other city departments and efficiency in these departments would greatly decrease if we had to go to the county for information 6. We are now sharing some city personnel between assessing and inspections and therefore the total savings would be less than the difference between the budget and the proposal . If the council approves their transfer, the records would be stored at our Research Center, 1500 Mississippi Street, St. Paul. They would be open for research use during regular business hours. They will, of course, be available to city officials. In an emergency, we will do limited amounts of records checking over the phone as well. The record types that the archives would accept include: minutes of council meetings, summary financial records (general ledgers and journals, registers of receipts and disbursements) , administrative correspondence, birth and death registers, and docket books of the justice and municipal courts. There are probably a few additional volumes of early utilities records that should be preserved. If the council approves transfer, we can discuss these. The city of Shakopee should be commended for preserving its records. The material I saw constituted one of the most complete set of municipal records I've seen. However, the current storage conditions leave much to be desired. Virtually all the records show evidence of mold infestation; some of it quite advanced. These need immediate fumigation and restoration to prevent severe records damage. As I indicated, these records may not be transferred from the city without the permission of the State Archivist. Because of Sha- kopee's proximity to St. Paul, we would strongly recommend transfer to the State Archives. There the records could get the proper resto- ration and storage that will maintain the documentation for your city's history. If we can be of assistance in any way, feel free to contact me. This will connect with other connecting easements over private lands (rural ) to provide a linear trail that will allow snowmobilers to legally traverse all over the County. Stop signs will be erected (for snowmobilers ) where the trail crosses Cty Rd #15. I endorse this plan and recommend that the Council will grant the request. These peiple have a very fine trail grooming machine that will insmre a good trail base providing that there is snow. The lease would be made with Scott County on behalf of the snowmobilers. It is the biggest thing going and is a concept difficult for a Council not to take a look at. Very fundamentally the procedure is this: 1. The City issues tax-exempt bonds. 2. The amount of the issue includes issuance costs. 3. The proceeds are deposited with a trustee who will administer the program. 4. Mortgage loans are made available to residents of the City usually on a City defined need basis which most often considers income levels and may also consider a mix of old and new housing. 5. A person seeking a mortgage goes to a conventional lender, i.e. bank or savings and loan in the program and applies for a loan which is made in the conventional manner except that it is at a lower rate of interest and may require a smaller down payment. 6. The lender then sells the mortgage to the trustee which buys it with bond proceeds. 7. The pool of mortgages, plus reserves from bond proceeds, plus investment earnings, plus insurances provide the security for the bonds which are probably rated "AAtt. The administration of the program, including the mortgage servicing may be done by the trustee and lenders, or the City may exercise some administration if it wishes. The administrative costs are paid from the spread between the tax-exempt rate of the bonds and revenues of the program. 9. The City's liability apparently comparable to its liability for an industrial development bond. Because the concept is being embraced by a widening circle of communities we are certain your Council will soon be solicited with a high degree of urgency to undertake a program. We would like to personally visit each of our clients to discuss the concept but in order to give equal priority in meeting the exigency of the demands we see forthcoming to Councils we've decided instead to conduct a seminar to explain the concept. You should be aware that there are some legal differences of opinion as to the current authority for this type of financing in Minnesota. Implementing legislation may be necessary. We expect to have some definite information to report on this score by the time of the meeting. If you are interested in learr ing more about this new financing concept we hope you will be able to attend. YoL are more than welcome to bring with you anyone of your Council, staff, HRA that you would like to. The seminar will commence at 10:00 A.M. Thursday, November 16th, will break for lunch, at which S-I will be pleased to have the participants be its guests, and will continue into the afternoon as need be. James S. This is to include all water piping, oversizing, valuing, water storage tanks, underground electric wiring, transformers, or anything necessary for the operation of the unit of that tax increment and that the Shakopee Public Utility Commission shall not incur any expenses for projects covered under this type of financing. BE IT FURTHER RESOLVED that all things necessary to carry out the terms of this resolution are hereby authorized and performed.
